1. Acceptance of Terms
By accessing or using any services provided by EU Brokers (Pty) Ltd("EU Brokers", "we", "us", or "our"), including our website and client portal, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a binding agreement between you and EU Brokers (Pty) Ltd, an authorised Financial Services Provider (FSP No. 46795 & 15451) registered in the Republic of South Africa.
2. Our Services
EU Brokers provides short-term insurance intermediary services, including but not limited to:
- Motor vehicle and household insurance brokerage
- Commercial and business insurance brokerage
- Agricultural, marine, aviation, and liability insurance brokerage
- Claims assistance and management on behalf of clients
- Insurance advice and policy recommendations
- Access to our secure client portal for policy and claims management
We act as an intermediary between you and insurance underwriters. We do not underwrite insurance policies ourselves. Any insurance product we recommend is subject to the terms, conditions, and exclusions of the relevant underwriter.
3. Portal Access & Accounts
Access to our client portal is by invitation only. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to:
- Provide accurate, current, and complete information when invited to create an account
- Promptly update your information if it changes
- Not share your login credentials with any third party
- Notify us immediately at delainy@eub.co.za if you suspect unauthorised access to your account
- Not use the portal for any unlawful purpose
We reserve the right to suspend or terminate your access to the portal at any time if we believe these Terms have been violated or if required by law.
4. Your Obligations
As a client of EU Brokers, you are obligated to:
- Disclose material information: Provide full and accurate information when applying for insurance cover. Non-disclosure or misrepresentation may result in a claim being rejected or a policy being voided by the underwriter.
- Notify changes promptly: Inform us of any changes to your insured risk, personal details, or circumstances that may affect your cover.
- Pay premiums on time: Ensure that premiums are paid as agreed. We are not liable for any claims arising from a policy that has lapsed due to non-payment.
- Report claims promptly: Notify us of any insurable event as soon as reasonably possible, and comply with the claims procedure of the relevant underwriter.
- Provide accurate claim information: Submit only true and accurate information in support of any claim. Fraudulent claims are a criminal offence in South Africa.
5. Intermediary Status & Advice
EU Brokers is licensed under the Financial Advisory and Intermediary Services Act, 2002 (FAIS Act). Our services constitute financial advisory and intermediary services as defined in the FAIS Act.
All advice and recommendations provided by EU Brokers are based on information you supply to us and the products available in the market at the time. It is your responsibility to read and understand the terms, conditions, and exclusions of any policy before accepting cover.
EU Brokers maintains Professional Indemnity insurance and complies with the Financial Sector Conduct Authority (FSCA) requirements. A copy of our FAIS Disclosure Document is available on request.
6. Claims & Documents
EU Brokers will assist you in lodging and managing insurance claims on your behalf. However:
- The decision to accept, reject, or settle a claim rests solely with the relevant underwriter, not with EU Brokers.
- Documents uploaded to the portal are stored securely and used solely for the purpose of processing your claim or policy.
- We cannot guarantee the outcome of any claim and are not liable for decisions made by underwriters.
- You must retain original documents relating to any claim, as we may require them at any stage of the process.
7. Limitation of Liability
To the fullest extent permitted by South African law, EU Brokers shall not be liable for:
- Any indirect, incidental, or consequential loss arising from the use of our services or portal
- Loss or damage caused by events beyond our reasonable control (force majeure)
- Decisions made by underwriters regarding your policy or claim
- Interruptions, errors, or security breaches in the portal caused by third parties
- Any loss resulting from your failure to comply with these Terms or your policy conditions
Our total liability to you for any claim arising from or in connection with these Terms or our services shall not exceed the amount of fees paid by you to EU Brokers in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as required by South African law.
8. Intellectual Property
All content on our website and portal — including text, graphics, logos, software, and documentation — is the property of EU Brokers (Pty) Ltd or its licensors and is protected by South African and international intellectual property law.
You may not copy, reproduce, distribute, or create derivative works from any content without our prior written consent. Your access to the portal grants you a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose only.
9. Privacy & Data Protection
The collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the processing of your personal information as described in that policy.
We comply with the Protection of Personal Information Act, 2013 (POPIA) and other applicable South African data protection legislation.
10. Termination
Either party may terminate the relationship by providing written notice. Upon termination:
- You remain responsible for any outstanding premiums or fees
- Any pending claims will continue to be processed to completion
- Your portal access will be revoked. You may request a copy of your data in accordance with our Privacy Policy.
- You are responsible for arranging alternative insurance cover, as termination of our brokerage relationship does not automatically cancel any underlying insurance policies.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, either party may refer the matter to mediation or, where applicable, to the FSCA Ombud for Financial Services Providers (FAIS Ombud).

12. Amendments
We reserve the right to amend these Terms at any time. We will notify registered clients of material changes via email and by updating the effective date at the top of this page. Continued use of our services after notification constitutes acceptance of the revised Terms.
We recommend you review these Terms periodically. The most current version will always be available on our website.
